Emefiele Seeks Court Intervention to Halt Further Prosecution by the Government
Suspended Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, has filed a plea before a Federal High Court in Lagos, requesting the cessation of further prosecution by the Federal Government through the Department of State Services (DSS).
Emefiele, who was arraigned on July 25 by the DSS on charges of illegal firearm possession, had been granted bail and was ordered to be held in prison custody. However, he was subsequently re-arrested by the DSS.
Through his legal representatives led by Mr. Joseph Daudu, SAN, Emefiele is now seeking a court order to dismiss all charges presented by the DSS. He argues that the DSS's actions blatantly disregard the existing court orders granting him bail on July 25, 2023.
He is also seeking a court order to prevent the Federal Government from receiving any form of leniency from the court unless it adheres to the bail ruling. Relying on constitutional and legal provisions, including the Administration of Criminal Justice Act, 2015, Emefiele's plea aims to halt ongoing proceedings in the current case until all legal avenues are exhausted to compel the government and the DSS to adhere to the court's orders.
Emefiele's application intends to employ the court's jurisdiction to enforce its orders, emphasizing the importance of upholding the court's authority and the rule of law in the democratic system. The DSS has responded to Emefiele's application, and the court is set to hear the case today.
