Retired Police DIG Seeks N550 Million in Damages through Mandatory Retirement Lawsuit

Moses Jitoboh, a Deputy Inspector General (DIG) of Police who was compulsorily retired, is seeking damages of N550 million, claiming that his retirement before the age of 60 was wrongful. He has filed a lawsuit in the National Industrial Court in Abuja, asserting that the Police Service Commission's (PSC) decision to retire him prematurely was unconstitutional and unlawful.


In August, the PSC announced Jitoboh's retirement, along with three others, citing the tradition of retiring officers when a junior officer is promoted over senior officers to prevent 'status reversal.'


Disagreeing with the PSC's decision, Jitoboh is now asking the industrial court not only to reinstate him but also to award him damages of N550 million, citing the "unwarranted embarrassment caused by the purported termination of my employment," which he believes portrayed him as disloyal.


In his statement of claims submitted to the court, Jitoboh argues that his compulsory retirement blatantly violates Rule 020810 of the Public Service Rules and Section 18 (8) of the Nigeria Police Act, 2020. Additionally, he is requesting the court to compel the PSC to pay an extra N50 million as the cost of filing the lawsuit.
