Court strikes out FCCPC criminal charge against MTN executives

The Federal High Court in Abuja has struck out a criminal charge filed by the Federal Competition and Consumer Protection Commission (FCCPC) against MTN Nigeria Communications Plc and its top officials. The suit was withdrawn by the FCCPC's lawyer, I.O. Aiaba, citing a notice of withdrawal filed on September 8.

Justice Hauwa Yilwa granted the application, striking out the suit. The FCCPC had accused MTN Nigeria and its officials of breaching the commission's Act by failing to produce documents and information required by a lawful summons.

The defendants, including MTN's Managing Director and CEO, Karl Toriola, were facing prosecution over allegations of non-compliance with the FCCPC's requests. However, no lawyer appeared for the defendants, and they were not present in court for the trial.

The FCCPC had previously accused the defendants of evading service of court documents and had involved the Nigeria Police Force to ensure their appearance in court. The case has been dismissed.
